Terms of Service
These Terms of Service ("Terms") govern your access to and use of the MOOV mobile application, website, connected hardware, and related services (collectively, the "Services") provided by MOOV Technologies Inc. ("MOOV", "we", "our", or "us"). Please read these Terms carefully before using the Services.
1. Acceptance of Terms
By downloading the MOOV app, creating an account, purchasing or using a MOOV device, accessing our website, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Services.
2. About MOOV
MOOV is a morning performance and productivity platform that includes a mobile app, connected hardware, and related services designed to help users build better morning habits, reduce distractions, and start the day with intention.
3. Eligibility
You must be legally able to enter into a binding agreement to use the Services. If you are under the age of majority in your jurisdiction, you may use the Services only with the consent and supervision of a parent or legal guardian.
4. User Accounts
When you create an account, you are responsible for providing accurate and complete information, keeping your login credentials secure, and maintaining the confidentiality of your account. You are responsible for all activity that occurs under your account. Please notify us immediately if you suspect unauthorized access.
5. Account Deletion
You may delete your account at any time from within the app or by contacting us. When you delete your account, we will delete or anonymize your associated personal information in accordance with our Privacy Policy, unless retention is required by law.
6. Acceptable Use
You agree to use the Services only for lawful purposes. You may not reverse engineer, copy, modify, redistribute, abuse, interfere with, or attempt to gain unauthorized access to the MOOV app, hardware, or services. You may not use the Services to harm, harass, or interfere with others.
7. Alarm & Device Disclaimer
MOOV is designed to help users wake up, but we cannot guarantee that alarms will always function correctly. Alarm performance may be affected by operating system restrictions, permissions, battery levels, Bluetooth or NFC connectivity, internet access, software updates, user settings, or hardware failure. You should always maintain a backup alarm for important events, appointments, or obligations.
8. Bluetooth & NFC
MOOV uses Bluetooth and/or NFC solely to communicate with compatible MOOV devices, such as to silence alarms or verify proximity. These technologies are not used to track your location or monitor your activity beyond the operation of your MOOV device.
9. Focus Lock & Productivity Features
Focus Lock and similar productivity features are intended to help users reduce distractions. However, we cannot guarantee that all distractions or operating system workarounds will be completely prevented. These features are tools to support your intentions, not a guarantee of focus or productivity.
10. Health Disclaimer
MOOV is a productivity and lifestyle product, not a medical device, healthcare service, or sleep treatment. MOOV is not intended to diagnose, treat, cure, or prevent any medical or sleep condition. If you have health-related concerns, including chronic sleep issues, please consult a qualified healthcare professional.
11. Orders, Reservations & Payments
Pricing, availability, reservations, deposits, and preorder dates are subject to change. Payment processing for purchases may be handled by secure third-party providers. By placing an order, you authorize us to charge the applicable payment method.
12. Returns & Warranty
Return, refund, and warranty policies for physical products will be provided separately and are subject to applicable consumer protection laws. Please review the specific return and warranty terms available at the time of purchase.
13. Software Updates
MOOV may release updates, improvements, bug fixes, and new features over time. Some updates may be required for continued functionality, security, or compatibility. By using the Services, you agree to receive such updates in accordance with your device settings.
14. Intellectual Property
All MOOV branding, logos, hardware designs, software, content, graphics, and other intellectual property belong to MOOV Technologies Inc. or its licensors. You may not copy, reproduce, modify, distribute, or use these materials without prior written permission, except as expressly permitted by these Terms.
15. Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
16. Third-Party Services
MOOV may rely on third-party providers for authentication, hosting, analytics, crash reporting, payment processing, and other operational needs. These services are governed by their own terms and policies. MOOV is not responsible for the practices or availability of third-party providers.
17. Service Availability
While we strive to provide reliable and continuous service, we cannot guarantee uninterrupted operation. The Services may be temporarily unavailable due to maintenance, outages, software issues, or events beyond our reasonable control.
18. Disclaimer of Warranties
The app, website, and Services are provided "as is" and "as available" to the maximum extent permitted by law. MOOV does not warrant that the Services will be uninterrupted, error-free, or completely secure, or that any defects will be corrected.
19. Limitation of Liability
To the fullest extent permitted by law, MOOV Technologies Inc. is not liable for indirect, incidental, consequential, special, or punitive damages arising from the use of the app or hardware, including missed alarms, missed appointments, lost income, or data loss, except where prohibited by applicable law. Our total liability is limited to the amount you paid for the Services in the twelve months preceding the claim.
20. Governing Law
These Terms are governed by and construed in accordance with the laws of Newfoundland and Labrador, Canada, without regard to its conflict of law principles.
21. Changes to These Terms
MOOV may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
